Q. I'm the association President for my condo association. We have a termite infestation that began in one of our units.

The owner of the unit with termites is on the top floor, which had flooding issues that rotted the wood around his window frames and this is where he has seen termites. Now, the entire building needs to get fumigated, which means more dollars out of our pockets. I feel that the termite problem originated in his unit as no other owners in the remaining 10 units have seen termites. Is that condo owner responsible for a larger share of the financial burden to take care of the problem?

A. The issue of whether the association is responsible for damage to units or common elements or if it can be charged back to a unit owner is a fairly common one. The answer will depend, however, on a number of factors. These include
