Q. We have an owner who is selling his unit and has asked the board for documents.

Can the board require a copy of the sale contract prior to providing the documents the owner has requested?


A. In general, a sale contract must be provided to the board when the association’s governing documents include a Right of First Refusal. This is a term often misunderstood by condo boards. The ROFR states that
